Owan-Enoh Remains APC Governorship Candidate In Cross River State – Obono-Obla

Chairman, Special Presidential Investigation Panel on the Recovery of Public Property, Mr. Okoi Obono-Obla has disclosed that the All Progressives Congress (APC) governorship candidate in the Cross River State election in 2019 , John Owan-Eno, remains the recognized candidate that would fly the party’s flag.

He stated this on Thursday where urged some of the aggrieved aspirants or members to shift their sword and support the candidacy of Owan-Enoh.

Obono-Obla, who revealed that despite a suit filed by three chieftains of the party in the state, Sylvester Okpo (APC Cross River South Senatorial District, Vice Chairman), Eugenia Takon (APC Cross River State ex-officio) and Charles Asim (APC Cross River State Youth Leader) to challenge the results of Owan-Enoh, he said that case has no bearing on the Primaries conducted by the National Working Committee in October to nominate the candidates of the APC in Cross River State in October 2018 in respect of Office of the Governor of Cross River State; National Assembly and State Assembly.

According to him, “I have read the five grounds of appeal filed by the Legal Adviser of the All Progressives Congress, APC on behalf of the Appellant (APC) seeking the Court of Appeal, Abuja to set aside the judgment of the High Court of the Federal Capital Territory, Abuja delivered today the 13 December 2018 concerning the Ward, Local Government Areas Congresses/ State Congress of the Party held in May 2018 in of the Plaintiffs.

“The Plaintiffs are Sylvester Okpo; Mrs Eugenia Takon and Charles Asim. Undoubtedly, the grounds of appeal are substantial and raises serious arguable of law and facts. Even though the Plaintiffs did not seek any relief(s) convening the conduct of the Primaries the learned Judge came into the arena and purported to suggest only the primaries conducted by Etim John Faction is the way to be recognized.

“This is strange and cannot stand. The Court is not Father Christmas and therefore cannot grant reliefs not sought by the Respondents/ Plaintiffs. It is well settled that in law a Court can only grant reliefs sought by the Plaintiff. The case has no bearing on the Primaries conducted by the National Working Committee in October to nominate the candidates of the APC in Cross River State in October 2018 in respect of Office of the Governor of Cross River State; National Assembly and State Assembly.

“Accordingly, distinguished Senator John Owan Enoh remains the Governorship candidate of APC. This is also applicable to candidates of the Party for National and State Assemblies. It is only the National Working Committee of Party that can Conduct Primaries to nominate candidates of that Party for the offices of President, National Assembly, State Governors and State Assemblies.

“This proposition has been given judicial approbation in the case of Gado vs CPC delivered by the Supreme Court in 2012. Most important , the APC has filed an appeal so the status quo remain pending the hearing and determination of the appeal. The Judgment is obviously perverse and cannot stand a review by the Court of Appeal.
